1. Introduction
Welcome to Eat Like a Local (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the www.eatlikealocal.co.za website (“Website”) and the services we provide, including but not limited to walking food tours in Cape Town and Hermanus, South Africa (“Tours”). By using this Website or booking a Tour, you indicate that you have read, understood, and agree to abide by these Terms at all times.

The information on this Website is prepared solely for the purpose of providing information about our Tours and facilitating online bookings for tickets (“Tickets”). By accessing the Website, you assume all risks associated with its use, including the risk of damage to your computer, software, or data from viruses transmitted or activated through the Website.

All content published on this Website, including but not limited to images, text, logos, documents, downloadable files, and other materials, is the property of Eat Like a Local and its creators.

2. Changes to Terms and Conditions
Eat Like a Local reserves the right to modify these Terms at any time. Any changes will take effect immediately upon publication on the Website. For existing Tickets, the Terms in effect at the time of booking will apply.

3. Third-Party Links
This Website may contain links to third-party websites. These links are provided for convenience only, and Eat Like a Local is not responsible for the availability, suitability, reliability, or content of such websites. We do not endorse the views expressed on third-party websites.

4. Food Tours
The services offered on this Website include the Tours displayed at the time of your access. While we strive to provide accurate descriptions and images of our Tours, we cannot guarantee their accuracy. You agree to purchase these services at your own risk.

  • Restaurant Stops and Menu Items: Eat Like a Local reserves the right to alter or change restaurant stops and/or menu items without notice due to product or venue unavailability. Suitable substitutes will be arranged.
  • Tour Duration: The length of the Tour may vary depending on group size, restaurant service times, and participant engagement. Please allow extra time at the end of the Tour before scheduling other activities.

5. Orders and Payment

  • Order Confirmation: Your order constitutes an offer to purchase Tickets. All orders are subject to acceptance by Eat Like a Local, and a contract is formed when we send you an Order Confirmation via email.
  • Group Bookings: If you book for a group, you are responsible for sharing these Terms with all participants.
  • Minimum Participants: A minimum of 2 guests is required for scheduled Tours. If this minimum is not met, we reserve the right to cancel the Tour and issue a refund.
  • Children: Children under 12 years old are not permitted on scheduled Tours but may be accommodated on private Tours.

6. Dietary Restrictions and Allergies
It is your responsibility to inform us of any dietary restrictions or allergies at the time of booking. While we strive to accommodate dietary needs, we cannot guarantee changes to the menu if notified only at the start of the Tour.

  • Vegetarians and Vegans: Vegetarians consuming dairy and gluten can be accommodated on all Tours. Vegans can be accommodated on private Tours only.
  • Severe Gluten Intolerance: We are unable to cater for severe gluten intolerance such as celiac disease.

7. Safety and Conduct

  • Risks: Participation in our Tours involves risks, including exposure to unfavourable weather conditions, food-related illnesses, and injuries. By participating, you accept these risks.
  • Due care: As we provide walking tours through public areas, guests should be aware of their surroundings, practice common sense, guard their personal possessions and be aware of the local rules and regulations applicable for pedestrians. Walking surfaces may be uneven in places and guests are required to apply necessary caution.
  • Conduct: Eat Like a Local reserves the right to refuse participation or remove any participant who behaves in a manner that endangers themselves or others, including but not limited to intoxication, aggression, or non-compliance with instructions. No refunds will be provided in such cases.
  • Instructions: Guests are obliged to abide by all reasonable instructions from the tour guide.

8. Cancellations and Refunds

  • Cancellation by You:
    • Cancellations made more than 14 days before the Tour date are eligible for free reschedule or a refund (after deducting booking platform and bank charges).
    • Cancellations between 14 days and 48 hours before the tour can be rescheduled at no cost, subject to availability.
    • Cancellations made within 48 hours of the Tour date are non-refundable.
  • Cancellation by Us: If we cancel a Tour due to unforeseen circumstances other than Force Majeure, you will receive a full refund or the option to reschedule.

9. Punctuality
Participants must arrive at the designated meeting point at least 10 minutes before the scheduled start time. Late arrivals may be considered a “no-show,” and no refunds will be provided.

10. Weather Conditions
Tours operate in all weather conditions unless they pose a safety risk. In such cases, we will cancel the Tour and issue a full refund. No refunds will be provided if you choose not to attend due to unfavourable weather.

11. Force Majeure
Eat Like a Local is not liable for failures or delays caused by events beyond our control, including but not limited to natural disasters, political unrest, pandemics, or transportation failures. In such cases, we will work with you to reschedule your booking.

We have the right to suspend or cancel the food Tour in case of failure of restaurants, cafe’s or street vendors, strikes, marches, unrest and any other situation in which we cannot exercise control.

12. Travel insurance
Eat Like a Local will not be held liable for any unforeseen circumstance that may happen. We strongly advise guests to obtain travel insurance. In the event of an unforeseen circumstance leading to a request for a refund not covered by our Cancellation Policy, guests should claim from their insurance provider.

13. Walking and Fitness
Guests acknowledge that they will participate in a walking tour and confirms that they are able to walk a reasonable distance (3 – 4 km). Walking is not overly strenuous (mostly flat with limited uphill sections), but guests are required to have moderate levels of fitness. If transportation (e.g., taxi or Uber) is required during the Tour, participants are responsible for the associated costs.

14. Liability
To the fullest extent permitted by South African law, Eat Like a Local, its employees, associates, suppliers, and contractors are not liable for any loss, damage, injury, or death arising from participation in our Tours. You agree to indemnify us from any loss or damage caused by your actions during the Tour.

15. Data and Privacy
We process your personal data in accordance with the Protection of Personal Information Act (POPIA). By using our services, you consent to the collection, use, and storage of your data as outlined in our Privacy Policy.

Photographs and video footage may be taken during Tours for promotional or editorial purposes. These images may be used online or in printed matter. If you do not want images of you or your clients to be used, please let us know in writing in advance of the Tour at admin@eatlikealocal.co.za.

16. Intellectual Property
All content on this Website, including text, images, videos, and graphics, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

17. Governing Law
These Terms are governed by the laws of South Africa. Any disputes arising from these Terms will be resolved in South African courts.
